NOTICE AND WARNING TO HAMPTON, NH TOWN CLERK AND FINANCE DIRECTOR “ACCOUNTABILITY OF MAGISTRATES AND OFFICERS; PUBLIC’S RIGHT TO KNOW”
The below notice was sent to Hampton Town Clerk Doheny and Town Finance Director Pulliam via Registered Mail and email.
Being that it was witnessed at least two ballot boxes were unsealed and unattended to in the town clerk’s vault on March 26, 2024, the day before the scheduled recount (March 27, 2024) (a violation of NH RSA 669:32), additional follow-up procedures in the form of a citizen audit were mandated.
To date, it should bs noted that;
1. There are multiple pictures that verify security seals on certain ballot boxes have been broken. See the attached photo as one example.
2. 14 ballot boxes were brought into recount, but were not opened.
3. On May 2, 2024, the town clerk was asked why some of the ballot box seals were broken, she stated that she "did NOT know who opened them."
Without effective ballot box "chain of custody" after an election, how can there be any integrity in the outcome of that election?
As part of these additional ongoing citizen audit procedures, the following requests are being made to the Hampton Town Clerk and the Town Finance Director to provide the following regarding the March 12, 2024 Hampton, NH Town Election. NOTE: These requests are being made utilizing Article 8 in the NH Bill of Rights, Part 1 of the State’s Constitution and are NOT NH RSA 91-A Public Right-to-Know requests.
1. Photographs of the remaining ballot boxes used in the March 12, 2024 Hampton, NH town election. (Per May 2, 2024 discussion with the town clerk there were a total of 45 ballot boxes provided by LHS Associates for the Hampton March 2024 town election and ten of these boxes had not been photographed as part of the citizen post recount audit process.) Please forward electronic copies of theses photographs to nhmuckraker1776@yahoo.com, AND
2. Copies of invoices for ALL ballots, including absentee ballots, ordered by the town for the March 12, 2024 town election. Please forward electronic copies to nhmuckraker1776@yahoo.com.
If these items are not adequately responded to by May 20, 2024, it will be noted as a violation of rights as defined in Article 8, Part One of the Bill of Rights in the NH Constitution; “Accountability of Magistrates and Officers; Public’s Right to Know. All power residing originally in, and being derived from, the people, all the magistrates and officers of government are their substitutes and agents, and at all times accountable to them. Government, therefore, should be open, accessible, accountable, and responsive. To that end, the public’s right of access to governmental proceedings and records shall not be unreasonably restricted.” The matter may become one for the federal court to settle.
There is no evidence of Ballot Box Chain of Custody in the Hampton NH March 2024 town election. The election and its results should be determined null and void.
