TRUTH BOMB TUESDAY - UNCONSTITUTIONAL TAX HIKES AND ASSESSMENTS

HAMPTON, NEW HAMPSHIRE.


TAXPAYERS have filed a legal challenge in the Rockingham County Superior court against the Town of Hampton. Taxpayers argue that the 2024 property tax increase—up 13.4% to nearly $75 million—was imposed through unconstitutional and disproportionate assessments.


While the town's assessed value increased by 54% or an almost $9 million additional in taxes raised, from 2023 to 2024, citizens argue this increase in valuation and taxation was disproportional. The town’s “market value” revaluation system violates both the New Hampshire Constitution - Part II Articles 5b and 6, and the U.S. Constitution - 16th Amendment.


The plaintiffs contend that:

State laws cannot override citizens’ constitutional rights and tax assessments must follow constitutional valuation rules, not speculative market estimates. Specifically, NH Constitution, part II, [Art] 5-b. states: [Power to Provide for Tax Valuations Based on Use.]  This means that if the town is basing the current tax for a home on the gains from a future sale of that home, it is not being taxed "based on the current use thereof" for two reasons: 1) if you sell a home or property you are very likely not using that home/property after selling it; 2) and, if the tax is on gains after the sale, while you are inhabiting and still own the home or property, and you have not sold the home, this taxation is fraudulent because it is based on future gains, and not "the current usage thereof."


The town ignored months of taxpayer grievances and failed to ensure equal, lawful taxation.


Now, the town, through its legal counsel, has filed a Motion to Dismiss. The motion cites, lack of evidence, lack of jurisdiction, and lack of standing to demand justice.


Taxpayers have objected with new demands of the Court.


Citing landmark rulings such as Norton v. Shelby County (1886), residents insist that unconstitutional acts are void and that justice requires the court to deny the town’s motion to dismiss and hear the case on its merits.


Hampton taxpayers are standing up for constitutional governance, fiscal fairness, and the rule of law.
